Welcome to the BizMind platform. These Terms of Service (hereinafter "Terms") constitute a legal agreement between you (hereinafter "User" or "you") and Infinity Intelligence Tech Limited (hereinafter "the Company" or "we"). By using this Service, you agree to be bound by these Terms.
1. Service Description
BizMind is an AI knowledge platform for SMEs, providing the following services:
- AI knowledge base construction and management
- Intelligent customer service assistant (supporting Chinese, English, Cantonese)
- WhatsApp / API third-party integration
- Enterprise data analysis and insights
2. Account Registration and Security
- You must be at least 18 years old to register an account
- You must provide accurate and complete registration information
- You are responsible for maintaining the confidentiality of your account password
- You are responsible for all activities under your account
- If you discover unauthorized use of your account, please notify us immediately
3. Acceptable Use
When using the BizMind service, you agree not to:
- Violate any applicable laws or regulations
- Upload content containing malware, viruses, or harmful code
- Attempt unauthorized access to other users' data or systems
- Use the service for fraud, harassment, or any illegal activity
- Exceed reasonable usage limits (including API abuse or automated attacks)
- Resell, sublicense, or commercialize this service (unless written permission is obtained)
- Upload content that infringes others' intellectual property rights
4. Intellectual Property
- Your Content: All knowledge base content, documents, and data you upload to BizMind remain your intellectual property
- Platform Rights: The BizMind platform software, design, trademarks, and related technology are the intellectual property of the Company
- Limited License: We grant you a non-exclusive, non-transferable license to use the features of this service
- AI-Generated Content: Responses generated through this service's AI are for reference only and do not constitute professional advice
5. Subscription and Payment
- Free plans provide limited features and usage at no cost
- Paid plans are billed monthly or annually, with fees charged at the beginning of each billing cycle
- All fees are quoted in Hong Kong Dollars (HKD) or US Dollars (USD)
- Upgrades take effect immediately; downgrades take effect at the next billing cycle
- We reserve the right to adjust pricing with 30 days' advance notice
6. Refund Policy
- Annual plans offer a 14-day unconditional refund guarantee
- Monthly plans are non-refundable (you may cancel at any time; service continues until the end of the billing cycle)
- For interruptions caused by major service failures, we will compensate on a pro-rata basis
7. Service Availability
- We strive to provide 99.9% service availability (Enterprise plan)
- Planned maintenance will be notified in advance, typically scheduled during off-peak hours
- Force majeure events (natural disasters, cyberattacks, etc.) are excluded from availability commitments
- During service interruptions, we will restore service as quickly as possible and notify affected users
8. Data Processing
- Your knowledge base data is used solely to provide the service to you and will not be used to train our models
- AI queries may be processed via third-party model providers (such as DeepSeek), who have committed not to use query data for model training
- Data storage location and security measures are detailed in our Privacy Policy
- After account termination, your data will be deleted according to the periods specified in the Privacy Policy
9. Disclaimer
- BizMind's AI responses are for reference only and do not constitute legal, medical, financial, or other professional advice
- We do not guarantee the accuracy, completeness, or timeliness of AI-generated content
- The service is provided "as is" without any express or implied warranties
- We are not liable for indirect losses arising from the use or inability to use the service
10. Limitation of Liability
To the maximum extent permitted by law, the Company's liability for any direct losses arising from your use of the service shall not exceed the total fees you paid for the service in the 12 months preceding the claim.
11. Termination
- You may cancel your subscription and stop using the service at any time
- If you violate these Terms, we reserve the right to suspend or terminate your account
- After termination, you have the right to export your knowledge base data (within 30 days before account deletion)
- Provisions relating to intellectual property, disclaimers, and dispute resolution survive termination
12. Dispute Resolution
- These Terms are governed by the laws of the Hong Kong Special Administrative Region
- Parties shall first attempt to resolve disputes through amicable negotiation
- If negotiation fails, any dispute shall be submitted to the Hong Kong International Arbitration Centre (HKIAC) for arbitration under its rules
- The language of arbitration shall be Chinese or English
13. Amendments to Terms
We may amend these Terms from time to time. Significant changes will be communicated 30 days in advance via email or in-platform notification. Continued use of the service constitutes acceptance of the amended Terms. If you do not agree to the new Terms, please stop using the service and cancel your account before the effective date.
